These Terms of Service ("Terms") govern your use of the MIassist mobile application ("App") operated by Jonathan Walling, doing business as MIassist ("we," "us," or "our"). By downloading or using the App, you agree to be bound by these Terms.
MIassist is a professional mobile inspection application designed for use by qualified field inspectors. You must be at least 18 years of age to use this App. You agree to use the App only for lawful purposes and in accordance with these Terms.
To access certain features of the App, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at miassist.co@gmail.com of any unauthorized use of your account.
You retain ownership of all inspection data, reports, photos, and other content you create using the App ("Your Content"). You are solely responsible for the accuracy, completeness, and legality of Your Content. We do not review, verify, or endorse any inspection findings or reports generated through the App.
MIassist is a tool to assist professional inspectors. The App does not replace the professional judgment, certifications, or qualifications required to perform inspections under applicable codes and standards (including but not limited to API 510, API 570, API 653, and STI SP001). You are solely responsible for ensuring that all inspections are performed in accordance with applicable regulations, standards, and your professional qualifications.
Certain features of the App may require a paid subscription. All payments are processed through the Apple App Store or Google Play Store. Subscription fees are charged in advance and are non-refundable except as required by applicable law or the policies of the respective app store.
The App, including its design, features, and underlying technology, is owned by Jonathan Walling / MIassist and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App.
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JONATHAN WALLING / MIASSIST BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Jonathan Walling / MIassist from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the App, your violation of these Terms, or your violation of any third-party rights.
We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time by contacting us at miassist.co@gmail.com.
We may update these Terms from time to time. We will notify you of material changes by updating the date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions.
